For many Skilled Worker visa applicants, the Certificate of Sponsorship (CoS) is an important part of the visa process.
If your employer tells you that your CoS is delayed, waiting for an allocation, or processing, it can be stressful.
This is especially true if your current UK visa is near expiry.
A CoS is an electronic record assigned by a licensed UK sponsor. It contains important information about the sponsored job and provides a reference number used for a skilled worker visa application.
But why can a CoS be delayed?
What Is a Certificate of Sponsorship?
A Certificate of Sponsorship is issued electronically by an approved UK sponsor to a worker they intend to employ.
For Skilled Workers:
✓ A Defined CoS is generally used for applicants applying for a Skilled Worker visa from outside the UK.
✓ An Undefined CoS is generally used for Skilled Workers applying from inside the UK.
✓ The sponsor must have the appropriate sponsorship permission and allocation to assign the CoS.
✓ The CoS contains details such as the sponsored job and salary.
The CoS itself is not a visa. Receiving one also does not automatically mean that the visa application will be approved.
Why Is My CoS Delayed?
There can be several reasons why an employer is unable to issue a CoS immediately.
1. Your Employer Does Not Have Enough CoS Allocation
Sponsors have allocations for Certificates of Sponsorship. If an employer has used its available allocation, it may need to request additional certificates from UK Visas and Immigration (UKVI).
Current Home Office guidance confirms that sponsors can request an increase to their CoS allocation through the Sponsorship Management System (SMS).
This can create a delay before the employer is able to assign your CoS.
2. The Employer’s Additional Allocation Request Is Being Considered
If the employer has requested additional Undefined CoS allocation, the request may need to be considered by UKVI.
GOV.UK currently states that additional Undefined CoS allocation requests are usually decided within 12 weeks, although they can take longer if further checks are required. A paid priority service is also available for eligible requests.
Importantly, using the priority service does not guarantee that the request will be approved.
3. The Sponsor’s Licence or Compliance Position Needs Attention
A CoS cannot simply be issued without the employer meeting the relevant sponsorship requirements.
If there are issues with the sponsor licence, compliance information, or other sponsorship requirements, this may affect the employer’s ability to assign a CoS.
The Home Office’s current Sponsorship Management System guidance shows that sponsors must manage their licence, allocations and sponsorship responsibilities through the SMS.
4. The Job Details Need to Be Checked
Sometimes the delay may relate to the proposed role itself.
The employer may need to review details such as:
✓ Job title and duties
✓ Occupation code
✓ Salary
✓ Employment details
✓ Sponsorship requirements
A valid Skilled Worker CoS needs to contain the required information about the sponsored job and salary.
5. Employer or HR Delays
Not every CoS delay is caused by UKVI.
Sometimes the employer’s HR or immigration team may still be collecting information, checking the role, completing sponsorship requirements or preparing the CoS.
If you have been told simply that your “CoS is delayed”, it is reasonable to ask the employer what stage the process has reached.
Does a Delayed CoS Mean My Visa Will Be Refused?
No.
A delay in obtaining a CoS does not by itself mean that your Skilled Worker visa will be refused.
However, timing can become important if your current UK immigration permission is approaching its expiry date.
A Skilled Worker application must meet the relevant validity requirements, including having a valid CoS issued within the permitted timeframe.
This is why it is important not to leave your visa planning until the last minute.
What If My Current Visa Is Expiring Soon?
If your current UK visa is due to expire while you are waiting for your employer to issue a CoS, you should seek appropriate immigration advice as soon as possible.
Do not assume that a CoS delay automatically extends your immigration permission.
Your options can depend on factors such as:
✓ Your current visa route
✓ Your visa expiry date
✓ Whether you are staying with the same employer
✓ Whether your job or salary has changed
✓ Whether a new CoS is required
✓ Your previous immigration history
Every case needs to be considered based on the individual’s circumstances.
What Should You Ask Your Employer?
If your CoS is delayed, you can ask your employer or HR team:
✓ Has the CoS allocation already been approved?
✓ Does the company currently have an available CoS allocation?
✓ Has an additional allocation request been submitted?
✓ Is any further information required?
✓ Have the job, salary and occupation details been checked?
✓ Is there any issue with the company’s sponsor licence?

Can You Still Change Employers?
If you are already in the UK on a Skilled Worker visa and are changing employers, the immigration requirements can be different from a straightforward extension with the same sponsor.
A new employer generally needs to be an approved sponsor, and the worker may need a new CoS and an update to their immigration permission before starting the new sponsored role.
