Skilled Worker Visa Expiring Soon? What Should You Check?

If you are in the UK on a Skilled Worker visa and your visa is due to expire soon, it is important not to leave your immigration plans until the last minute.

Your next step could depend on your current job, employer, salary, Certificate of Sponsorship (CoS), visa history and whether you may now qualify for settlement.

The rules can also change, so it is important to look at your individual circumstances before making an application.

When Should You Start Checking Your Options?

You should start reviewing your situation well before your current visa expires.

This gives you time to consider whether you may need:

✓ A Skilled Worker visa extension
✓ An update to your visa because of a change of employer or job
✓ A new Certificate of Sponsorship (CoS)
✓ A different immigration route
✓ An application for Indefinite Leave to Remain (ILR), if eligible

The right option will depend on your circumstances.

1. Check Your Current Visa Expiry Date

The first thing to check is the expiry date of your current Skilled Worker visa.

Do not assume that your employer or CoS automatically extends your immigration permission. Your visa status and the conditions attached to your permission should be reviewed separately.

If your visa is approaching its expiry date, it is sensible to seek advice early rather than waiting until the final few weeks.

2. Has Your Employer or Job Changed?

Your Skilled Worker visa is connected to your sponsored employment.

If you are still working for the same employer and in the same role, you may be able to apply for an extension if you continue to meet the relevant requirements.

However, if you have:

✓ Changed employer
✓ Changed your job or occupation
✓ Moved into a substantially different role
✓ Had changes to your sponsorship
✓ Received a new CoS

you may need to update your immigration permission rather than simply extend your existing visa.

3. Check Your Certificate of Sponsorship

Your Certificate of Sponsorship is an important part of your Skilled Worker immigration status.

Before your visa expires, check whether your employer has the appropriate sponsorship arrangements in place and whether a new CoS may be required.

A CoS on its own does not guarantee that a visa application will be successful. Other immigration requirements may also need to be considered.

4. Review Your Salary and Role

Salary and job requirements can be important when extending or updating a Skilled Worker visa.

Changes such as:

✓ A new salary
✓ A promotion
✓ A change in working hours
✓ A change in occupation code
✓ A change in job duties

may affect your immigration position.

If your employment circumstances have changed since your last application, it is worth checking how those changes could affect your next application.

5. Could You Be Eligible for ILR?

If you have been living and working in the UK for several years, your visa expiry may be an opportunity to check whether you are approaching Indefinite Leave to Remain (ILR) eligibility.

Some Skilled Worker visa holders may qualify for settlement after meeting the relevant qualifying period and other requirements.

However, ILR has its own eligibility criteria, and simply holding a Skilled Worker visa for a certain period does not automatically mean that you qualify.

If you are close to your settlement qualifying period, it may be useful to review your position before deciding whether another visa extension is necessary.

6. Don’t Forget Your Dependants

If your partner or children are in the UK as your dependants, check their visa expiry dates as well.

A dependant’s immigration permission does not necessarily extend automatically when the main applicant extends their Skilled Worker visa.

Their individual circumstances and eligibility should therefore be considered when planning your next application.

7. What If Your Visa Is Expiring Very Soon?

If your Skilled Worker visa is expiring soon, don’t wait until the last minute to start looking at your options.

You should consider:

✓ Your current visa expiry date
✓ Your current employer and job
✓ Your salary and occupation
✓ Whether a new CoS is required
✓ Whether you may qualify for ILR
✓ Your dependants’ immigration status
✓ Any changes in your personal or employment circumstances

The appropriate route can vary from person to person.
